MED-LEGAL EVALUATIONS

We address Med-legal questions in a Multidisciplinary Team Approach.

Our group is specialized in medico-legal assessments and addresses the entitlement tests applied to specified Accident Benefits (such as Income Replacement benefits, Non-earner Benefits, etc.), catastrophic impairment evaluations, and complicated questions such as causation and statutory thresholds.

 

Our group is comprised of experienced personal injury lawyers, medical doctors, and other qualified health professionals.

We employ our legal knowledge and the interpretations developed by courts and tribunals to answer questions related to medico-legal questions.

Our reports typically include legal parts and medical parts. The legal part outlines and emphasizes how courts and tribunals have interpreted the acts and regulations.

The medical part answers the medical questions in light of the legal analysis devolved by courts and tribunals.

 

To ensure the reliability and credibility of the reports, our team of medical assessors routinely engages in collateral interviews of spouses, siblings, family relatives, friends, family physicians, supervisors, colleagues, and others.

The Catastrophic Determination Assessments are carried out in accordance with the Statutory Accident Benefits Schedule (SABS) and the American Medical Association (AMA) Guides to the Evaluation of Permanent Impairment.

Upon receipt of the referral, a clinical review of the medical file will be undertaken by our clinical coordinator of the assessment team. After examining the available file information, the clinical coordinator will propose multidisciplinary assessments. Each assessor will prepare a report summarizing the clinical history, the examination findings and results of any tests administered, relevant information extracted from the file documentation, and a clinical opinion regarding the nature, severity, causation, and stability of any identified impairments. Based on the cumulative information during the assessment, and taking into consideration the findings and conclusions reported by each Assessor, the clinical coordinator, in consultation with each assessor, as appropriate, will subsequently prepare a final consensus report. An integrated impairment analysis report will outline all identified impairments and will provide a conclusive determination.
